释义	法律分析: 根据我国相关法律规定，民间借贷的利率可以适当高于银行的利率，但最高不得超过年利率24%。超出此限度的，超出部分的利息不予保护。公民的合法权益受到侵害时有权向人民法院提起诉讼。法律依据: 《中华人民共和国民法典》第三百八十七条债权人在借贷、买卖等民事活动中，为保障实现其债权，需要担保的，可以依照本法和其他法律的规定设立担保物权。第三人为债务人向债权人提供担保的，可以要求债务人提供反担保。反担保适用本法和其他法律的规定。
