生育津贴怎么领

释义

法律主观：

生育津贴的领取是，女职工自生育之日起90天内由单位提交资料，审核通过社保局进行建档，再打款给公司，由用人单位向女职工发放。依法参加生育保险的职工，生育后可以领取生育津贴。

法律客观：

《社会保险法》第五十六条职工有下列情形之一的，可以按照国家规定享受生育津贴：(一)女职工生育享受产假；(二)享受计划生育手术休假；(三)法律、法规规定的其他情形。生育津贴按照职工所在用人单位上年度职工月平均工资计发。
