问题	人大代表暂停职务的情形
释义	法律主观：暂时停止执行代表职务，是指人大代表在任期内，因刑事案件被羁押正在受侦查、起诉、审判，或者被依法判处管制、拘役或者有期徒刑而没有附加剥夺政治权利，正在服刑，而原选区选民或者原选举单位又没有罢免其代表职务的，应暂时停止执行代表职务。有下列情形之一的，暂时停止执行代表职务：(一)因刑事案件被羁押正在受侦查、起诉、审判的;(二)被依法判处管制、拘役或者有期徒刑而没有附加剥夺政治权利，正在服刑的。前款所列情形在代表任期内消失后，恢复其执行代表职务，但代表资格终止者除外。
