释义	根据最高人民法院、最高人民检察院公布的一份司法解释，恶意透支信用卡，累计数额在五万元以上不满五十万元的，将被认定为刑法规定的恶意透支信用卡数额较大。根据我国刑法第一百九十六条规定，恶意透支信用卡，数额较大的，处五年以下有期徒刑或者拘役，并处二万元以上二十万元以下罚金。该司法解释明确，持卡人以非法占有为目的，超过规定限额或者规定期限透支，经发卡银行两次有效催收后超过三个月仍不归还的，即为刑法规定的恶意透支。
