释义	法律分析：我国刑法基本原则的是：1、罪刑法定原则：根据法律明文来决定是否定罪处刑；2、罪刑相适应原则：犯罪分子受到的刑罚轻重要和他犯得罪行和所要承担的刑事责任相符；3、罪责自负原则：谁犯罪就由谁承担责任。法律依据：《中华人民共和国刑法》第三条法律明文规定为犯罪行为的，依照法律定罪处刑；法律没有明文规定为犯罪行为的，不得定罪处刑。第四条对任何人犯罪，在适用法律上一律平等。不允许任何人有超越法律的特权。第五条刑罚的轻重，应当与犯罪分子所犯罪行和承担的刑事责任相适应。
