租赁是一种以一定费用借贷实物的经济行为，出租人将自己所拥有的某种物品交与承租人使用，承租人由此获得在一段时期内使用该物品的权利，但物品的所有权仍保留在出租人手中。承租人为其所获得的使用权需向出租人支付一定的费用(租金)。租聘，是一种以一定费用借贷实物的经济行为。在这种经济行为中，出租人将自己所拥有的某种物品交与承租人使用，承租人由此获得在一段时期内使用该物品的权利，但物品的所有权仍保留在出租人手中。承租人为其所获得的使用权需向出租人支付一定的费用。

第七条国务院建设行政主管部门、土地管理部门依照国务院规定的职权划分，各司其职，密切配合，管理全国房地产工作。县级以上地方人民政府房产管理、土地管理部门的机构设置及其职权由省、自治区、直辖市人民政府确定。
第五十四条房屋租赁，出租人和承租人应当签订书面租赁合同，约定租赁期限、租赁用途、租赁价格、修缮责任等条款，以及双方的其他权利和义务，并向房产管理部门登记备案。
