释义	律师分析: 出租居住房屋的，应当以一间按照住宅设计规范设计为居住空间的卧室或者起居室(厅)为小出租单位，不得分隔搭建后出租。按照住宅设计规范设计为餐厅、厨房、卫生间、阳台、过厅、过道、贮藏室、地下室、半地下室等其他非居住空间的，不得出租供人员居住。【法律依据】: 《商品房屋租赁管理办法》第六条有下列情形之一的房屋不得出租：(一)属于违法建筑的;(二)不符合安全、防灾等工程建设强制性标准的;(三)违反规定改变房屋使用性质的;(四)法律、法规规定禁止出租的其他情形。
