释义	没有备案的租赁合同一般情况下有效，当事人约定以办理登记备案手续为房屋租赁合同生效条件的，从其约定。但当事人一方已经履行主要义务，对方接受的除外。法律依据：《最高人民法院关于审理城镇房屋租赁合同纠纷案件具体应用法律若干问题的解释》第四条当事人以房屋租赁合同未按照法律、行政法规规定办理登记备案手续为由，请求确认合同无效的，人民法院不予支持。当事人约定以办理登记备案手续为房屋租赁合同生效条件的，从其约定。但当事人一方已经履行主要义务，对方接受的除外。
