释义	法律分析：从2023年1月1日起，现行的《婚姻法》将正式废除，新的《民法典》则正式生效。对于目前离婚率过高，婚内出轨问题严重的情况，根据《民法典》第1091条之规定，对于夫妻双方中的任何一方有重婚或者与他人同居行为;存在家庭暴力或者虐待、遗弃家庭成员以及有其它重大过错导致离婚的，那么，无过错方有权请求损害赔偿。另外，对于“重大过错导致离婚”这一情况包括：夫妻一方与他人发生不正当男女关系，但是又没达到同居的程度，经法院认定具有重大过错的，那么无过错方就可以请求获得损害赔偿。
