释义	法律分析：犯罪行为包括作为和不作为两种形式。 1、作为是指犯罪人用积极的行为实施的刑法禁止的危害社会行为，即不当为而为之。作为是人的身体的积极动作。如果行为人违反刑法禁止性规范，即违反不当为的义务而实施某种行为的，就成为危害行为中的作为。 2、不作为是指犯罪人有义务实施且可能实施某种积极的行为而未实施的行为，即当为而不为。法律依据：《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
