小型电摩需要驾驶证吗 |

法律分析:
电动车摩托车需要驾驶证，因为电动摩托车的最高车速已经超过25km/h，车身质量也超过55KG，并且没有脚踏骑行功能。按照《电动自行车安全技术规范》显示，最高时速、车身质量、结构不符合标准的，就已经属于机动车的范畴，所以是需要驾驶证才能开的。
驾驶电动车摩托车需要D、E、F驾驶证其中之一，至于具体要持有哪个还得看电动摩托车的具体车速和功率。按照规定，新国标电动车正式实施后，电动车分为电动车自行车、电动轻便摩托车、电动普通二轮摩托车三种。
电动车也是有分类的，可大致分为电动助力车与电动摩托车，有脚蹬子、且行驶最高时速不超过40的就是助力车，这一类是不需要驾驶证行驶证就和自行车一样，反之没有脚蹬子设计、最高行驶时速在40码以上的就是电摩这一类是需要驾驶证并上牌缴纳国家相关规费的。

《中华人民共和国道路交通安全法》 第十九条 驾驶机动车，应当依法取得机动车驾驶证。申请机动车驾驶证，应当符合国务院公安部门规定的驾驶许可条件；经考试合格后，由公安机关交通管理部门发给相应类别的机动车驾驶证。持有境外机动车驾驶证的人，符合国务院公安部门规定的驾驶许可条件，经公安机关交通管理部门考核合格的，可以发给中国的机动车驾驶证。驾驶人应当按照驾驶证载明的准驾车型驾驶机动车；驾驶机动车时，应当随身携带机动车驾驶证。公安机关交通管理部门以外的任何单位或者个人，不得收缴、扣留机动车驾驶证。
