释义	法律分析：质押和抵押的根本区别在于是否转移担保财产的占有。抵押不转移对抵押物的占管形态，仍由抵押人负责抵押物的保管；质押改变了质押物的占管形态，由质押权人负责对质押物进行保管。法律依据：《中华人民共和国民法典》第四百二十五条为担保债务的履行，债务人或者第三人将其动产出质给债权人占有的，债务人不履行到期债务或者发生当事人约定的实现质权的情形，债权人有权就该动产优先受偿。前款规定的债务人或者第三人为出质人，债权人为质权人，交付的动产为质押财产。
