释义	法律分析：二审又称上诉审程序，是第二审人民法院根据上诉人的上诉，就第一审人民法院尚未发生法律效力的判决或裁定认定的事实和适用法律进行审理时，所应当遵循的步骤和方式方法。法律依据：《中华人民共和国刑事诉讼法》第一百八十七条第二审人民法院对上诉案件，应当组成合议庭，开庭审理。合议庭经过阅卷，讯问被告人，听取其他当事人、辩护人、诉讼代理人的意见，对事实清楚的，可以不开庭审理。对人民检察院抗诉的案件，第二审人民法院应当开庭审理。
