产假现在是158天吗
释义
国家法定的基础产假是98天，不是158天。
只是部分省份的计划生育条例对依法办理结婚登记的夫妻和符合条例生育子女的，有奖励延长产假天数。其中，山西、安徽、江西、宁夏奖励延长产假60天，即一共休产假158天。
法律依据：
《女职工劳动保护特别规定》第七条
女职工生育享受98天产假，其中产前可以休假15天；难产的，应增加产假15天；生育多胞胎的，每多生育1个婴儿，可增加产假15天。
女职工怀孕未满4个月流产的，享受15天产假；怀孕满4个月流产的，享受42天产假。
