问题	非法经营普通员工有罪吗
释义	本罪在主观上要求行为人必须是出于故意，对于因不知其为非法而进行非法经营的，不认为构成本罪，而只能给予行为人以行政处罚。非法经营罪的处罚根据刑法第225条的规定，犯本罪的，处5年以下有期徒刑或者拘役，并处或者单处违法所得1倍以上5倍以下罚金；情节特别严重的，处5年以上有期徒刑，并处违法所得1倍以上5倍以下罚金或者没收财产。根据刑法第231条的规定，单位犯非法经营罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员按照上述法定刑判处刑罚。
