释义	劳动者辞职后，个人档案应当由用人单位转送新单位，没有新单位的转送劳动部门下公共就业服务机构或者设区劳动保障所。【本文关联的相关法律依据】劳动部、国家档案局《企业职工档案管理工作规定》劳力字〔1992〕33号第十八条企业职工调动、辞职、解除劳动合同或被开除、辞退等，应由职工所在单位在一个月内将其档案转交其新的工作单位或其户口所在地的街道劳动（组织人事）部门。职工被劳教、劳改，原所在单位今后还准备录用的，其档案由原所在单位保管。
