用人单位调整岗位对员工明显不利的,或者故意调离工作岗位的,没有与员工协商单方调整员工的工作岗位的,用人单位在短时间内频繁让员工调整工作岗位的属于恶意调岗;用人单位恶意调岗的,劳动者可以拒绝,或可以向当地劳动保障部门投诉。
