赠与是单务合同还是双务合同
释义
赠与合同是单务合同。
双务与单务的区别在于是否双方都负有义务。在赠与合同中，受赠人并无对待给付义务，仅赠与人负有给付赠与财产的义务，故赠与合同为单务合同。赠与合同中，赠与人不享有双务合同当事人可享有的合同履行抗辩权，也不要求受赠人有民事行为能力，无民事行为能力人同样可以成为赠与合同的受赠人，赠与人不能以受赠人无民事行为能力为由而主张赠与合同无效。
