释义	无效。《继承法》第二十八条规定，遗产分割时，应保留胎儿的继承份额。胎儿还未出生，被继承人死亡，在分割遗产时应保留胎儿的继承份额，这是因为被继承人死亡，承担抚育子女的责任、义务也随之消失，但胎儿是需要抚育的，保留胎儿的继承份额，可以最大限度地满足其成长需要，减轻生存压力。最高人民法院关于贯彻执行《中华人民共和国继承法》若干问题的意见第四十五条，应当为胎儿保留的遗产份额没有保留的，应当从继承人继承遗产中扣回，也就是说，扣回胎儿应继承的份额后，其他继承人继承的遗产才有效。
