释义	法律分析：在中国有经常居所或者营业所的外国人、外国企业和外国其他组织在专利权的保护上可以享受国民待遇,即与本国国民一样有权申请专利,从而获得专利保护法律依据：《中华人民共和国专利法》第四十二条发明专利权的期限为二十年，实用新型专利权和外观设计专利权的期限为十年，均自申请日起计算。第四十四条有下列情形之一的，专利权在期限届满前终止： 1、没有按照规定缴纳年费的。 2、专利权人以书面声明放弃其专利权的。专利权在期限届满前终止的，由国务院专利行政部门登记和公告。
