网站上赌博输的钱可不可以找回来 |

法律分析：不能，行为人在网络赌博活动中输掉的钱，一般是不能找回的，公安机关对于赌资应依法全部上缴国库。这是涉赌资金，依法应当没收。金额巨大，假如赌输的钱并未给到对方，可以通过司法途径解决，报警或者法院诉讼，但是由于本身赌博是不合法的，自己需要承担因为赌博造成的法律责任，但是金钱损失会降到最低。赌博本身就是违法行为，如果输的钱已经给到了对方，赌博不会因为你赢了或者输了而有所改变，换句话说，即使赢了，照样涉嫌赌博罪。而那些组织者，涉嫌开设赌场罪。假设警方破案了，顺利追回这几十万。只是偶尔参与的话，属于违反治安管理处罚法的行为，报警会被给与处罚，所有的人都会被处罚，非法所得直接没收。《刑法》规定，以营利为目的，聚众赌博或者以赌博为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。
法律依据：《中华人民共和国治安管理处罚法》 第七十条 以营利为目的，为赌博提供条件的，或者参与赌博赌资较大的，处五日以下拘留或者五百元以下罚款；情节严重的，处十日以上十五日以下拘留，并处五百元以上三千元以下罚款。
《中华人民共和国刑法》 第三百零三条 以营利为目的，聚众赌博或者以赌博为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。
