释义	法律分析: 视情况而定，如果出租人与承租人没有约定转租不能提高租金，承租人可以以更高的租金转租给次承租人，所得利益由承租人取得。如果双方对于转租没有约定且出租人事后对于转租拒绝追认的，或者约定禁止转租的，那么承租人即使提高租金，也有可能因承担违约责任而被次承租人要求返还。当事人另有约定除外。法律依据: 《中华人民共和国民法典》第七百一十六条承租人经出租人同意，可以将租赁物转租给第三人。承租人转租的，承租人与出租人之间的租赁合同继续有效；第三人造成租赁物损失的，承租人应当赔偿损失。
