假想的不犯罪构成犯罪吗

释义

法律主观：

假想犯罪有可能构成犯罪，如果行为人只是自行假想但是没有实际犯罪行为的一般不构成犯罪；如果行为人假想犯罪，为犯罪预备，并实施了犯罪行为或者造成了损害后果的构成犯罪。

法律客观：

《刑法》第二百五十九条，明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。利用职权、从属关系，以胁迫手段奸淫现役军人的妻子的，依照本法第二百三十六条的规定定罪处罚。
