释义	法律分析：原最高人民法院关于未经对方当事人同意私自录音取得的资料能否作为证据使用问题的批复曾经要求：未经对方当事人同意私自录音取得的资料不能作为证据使用，以违法证据排除规则排除使用。法律依据：《最高人民法院关于修改的决定》第六十八条以侵害他人合法权益或者违反法律禁止性要求的方法取得的证据，不能作为认定案件事实的按照。对录音证据而言就是说，如果录音证据的持有者采用了侵犯他人隐私或者违反法律禁止性的要求，比如录有他人隐私或在其工作或住所窃听取得的录音资料，仍然会被排除使用。
