兵龄如何认证为工龄

释义

法律主观：

工龄可以根据档案、缴纳养老保险的有关凭证等来认定。如果档案里有中断，比如劳教，入狱服刑等，领取疾病救济费等不计算工龄的时间。如果是临时工，有单位的劳动合同书和缴纳的社会保险证明也可以认定参加工作时间。

法律客观：

劳动保险条例实施细则修正草案第三十八条一般工龄系指工人职员以工资收入为生活资料之全部或主要来源的工作时间而言。在计算一般工龄时，应包括本企业工龄在内。
