按照继承法第十条遗产按照下列顺序继承：第一顺序：配偶、子女、父母。第二顺序：兄弟姐妹、祖父母、外祖父母。继承开始后，由第一顺序继承人继承，第二顺序继承人不继承。没有第一顺序继承人继承的，由第二顺序继承人继承。老人去世后，其财产应当由其以上第一种亲属如果都健的话，公平分配，当然若有遗嘱，按遗嘱约定！房子是使用权，首先要明白使用权是谁的使用，如果是老人的使用权，其去世后，使用权应当消失，不属于其财产，不能继承，比如过去单位分配的没有产权，仅限其居住，去世后单位收回的。
