法律分析：
根据我国刑法的规定，有配偶而重婚的，或者明知他人有配偶而与之结婚的，处2年以下有期徒刑或者拘役。因此，对于婚外情一方，重婚罪肯定是要判刑的，即使是拘役，也属于刑事处罚。对于明知他人有配偶而与之结婚的，也是触犯刑法的。同时对于那些情愿做婚外情的第三者的，也可能触犯刑法，受到刑事处罚。

《中华人民共和国刑法》 第二百五十八条 有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
