释义	法律分析：如果劳动者已经和用人单位解除了劳动合同，原单位已经解散，劳动者的档案丢失，致使到了退休年龄无法退休，劳动者可以到当地劳动机关，那里应当有备份或者移交的档案。法律依据：《企业职工档案管理工作规定》第十八条企业职工调动、辞职、解除劳动合同或被开除、辞退等，应由职工所在单位在一个月内将其档案转交其新的工作单位或其户口所在地的街道劳动(组织人事)部门。职工被劳教、劳改，原所在单位今后还准备录用的，其档案由原所在单位保管。
