释义	法律分析: 积极义务又称作为义务，是指以义务人须为一定行为（作为)为内容的义务。积极义务是由命令性规则所规定的，人们必须或者应当作出某种行为的规则。消极义务又叫不作为义务，是禁止性规则所规定的，禁止人们作出一定的行为。法律依据: 《中华人民共和国民法典》第五条民事主体从事民事活动，应当遵循自愿原则，按照自己的意思设立、变更、终止民事法律关系。第八条民事主体从事民事活动，不得违反法律，不得违背公序良俗。
