释义	法律分析： (1)申诉必须由受行政处分的国家公务员或者国家行政机关任命的工作人员自己提出，如受处分人已死亡，其近亲属也可以为提出。 (2)必须有明确的申诉请求和理由。 (3)必须向有管辖权的监察机关提出申诉。 (4)必须在法定的申诉期限内提出，即自接到行政处分决定书之日起的30日之内提出。法律依据：《中华人民共和国刑事诉讼法》第二百五十二条当事人及其法定代理人、近亲属，对已经发生法律效力的判决、裁定，可以向人民法院或者人民检察院提出申诉。
