一、挖一棵红豆杉会判刑吗
1、挖一棵红豆杉是会判刑的，挖红豆杉涉嫌非法采伐、毁坏国家重点保护植物罪。
2、法律依据：
（1）《中华人民共和国刑法》第三百四十四条，违反国家规定，非法采伐、毁坏珍贵树木或者国家重点保护的其他植物的，或者非法收购、运输、加工、出售珍贵树木或者国家重点保护的其他植物及其制品的，处三年以下有期徒刑、拘役或者管制，并处罚金；
情节严重的，处三年以上七年以下有期徒刑，并处罚金。第三百四十六条单位犯破坏环境资源罪的处罚规定单位犯本节第三百三十八条至第三百四十五条规定之罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照本节各该条的规定处罚。
（2）《最高人民法院关于审理破坏森林资源刑事案件具体应用法律若干问题的解释》第二条具有下列情形之一的，属于非法采伐、毁坏珍贵树木的行为“情节严重”。
(1)非法采伐珍贵树木2株以上或者毁坏珍贵树木致使珍贵树木死亡3株以上的；
(2)非法采伐珍贵树木2立方米以上的；
(3)为首组织策划、指挥非法采伐或者毁坏珍贵树木的；
(4)其他情节严重的情形。
二、种罂粟多少棵要判刑
罂粟是一种植物，而这种植物的果实是可以用于制造毒品的.所以种植罂粟是有限制的，需要经国家相关部门的批准才能种植，如果非法种植罂票的有可能构成犯罪。依据我国刑法的规定，种植罂粟达到五百株以上不满三千株的，就会构成非法种植毒品原植物罪，要追究刑事责任。
