释义	法律分析：由法院以成文法的方式制定。我国刑罚分为主刑和附加刑两大类。主刑包括：管制、拘役、有期徒、无期徒刑、死刑；附加刑包括：罚金、剥夺政治权利、没收财产。我国刑罚只能由刑法加以规定，除刑法以外，其他任何法律都无权规定刑罚体系。而且，刑种按照由轻到重的顺序加以排列，人民法院必须依法按照这些刑罚方法及条件、幅度、方式来判处刑罚。法律依据：《中华人民共和国刑法》第六十一条对于犯罪分子决定刑罚的时候，应当根据犯罪的事实、犯罪的性质、情节和对于社会的危害程度，依照本法的有关规定判处。
