法律分析：公共场所抽烟,处警告或者五百元以下罚款;情节严重的,处五日以下拘留。在禁止吸烟的公共场所，公民有权要求吸烟者停止吸烟；有权要求禁止吸烟的公共场所的管理单位履行本规定的职责；有权向卫生行政管理部门举报违反规定的行为。
法律依据：《中华人民共和国消防法》 第六十三条 违反本法规定，有下列行为之一的，处警告或者五百元以下罚款;情节严重的，处五日以下拘留：(一)违反消防安全规定进入生产、储存易燃易爆危险品场所的;(二)违反规定使用明火作业或者在具有火灾、爆炸危险的场所吸烟、使用明火的。
