释义	法律分析：在我国，嫖娼不构成犯罪，是违法行为，情节较轻的一般处以拘留或者罚款。情节较轻的情形： 1.如果双方已经谈妥了价格并且付了金钱等财物，但还未发生性关系的； 2.第一次进行卖淫嫖娼，但是认错态度较好，表示悔改或是有其他的特殊原因； 3.其他较轻情节的情形。法律依据：《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
