释义	不属于合同，只是有合同的性质。中标通知书具有承诺的性质，建设单位向中标人送达中标通知书，合同即告成立。招标人改变中标结果，更换施工队伍，或者中标人放弃中标项目，应当承担违约责任。法律依据: 《中华人民共和国民法典》第四百六十五条依法成立的合同受法律保护。依法成立的合同只对当事人有法律约束力，法律另有规定的除外。第五百二条规定:依法成立的合同，自成立以来生效，但法律另有规定或者当事人另有约定的除外。
