释义	国家对于贷款年利率超过36%的，不予保护。也就是说利息高于36%，就算高利贷。对以后注意这里所说的36%是年利率。如果合同中约定的是日利率，应当换算成年利率再比较。法律依据:最高人民法院《关于审理民间借贷案件适用法律若干问题的规定》第二十六条如果贷款年利率超过36%，则会被判定为高利贷并且超出部分的利息约定无效，甚至借款人已经支付的超出部分利息也可以追回。
