网购包裹物业该不该代收

法律分析：签收快递或包裹是收件人本人的责任，原则上小区保安或物管人员没有代为签收的义务，特别是一些重要或贵重物品。物管公司是服务公司，在物管合同服务条款中包含了帮业主处理一些事物的义务。如果物管帮忙代收了，而包裹出现丢失或损坏，那么物管还是存在一定的保管责任。快递过程中，包裹如果遗失、损坏，由快递公司承担主要责任。
法律依据：《中华人民共和国邮政法》 第四十七条 未保价的给据邮件丢失、损毁或者内件短少的，按照实际损失赔偿，但最高赔偿额不超过所收取资费的三倍。
