释义	《票据法》第13条第3款对票据抗辩下的定义是“票据债务人根据本法规定对票据债权人拒绝履行义务的行为。” 进行票据抗辩的主体只能够是票据债务人，除票据债务人以外的人不能行使票据抗辩权。先诉抗辩权是根据民法典的规定，一般情况下，在保证合同约定保证人承担一般保证责任时，保证人享有先诉抗辩权，在主合同纠纷未经审判或者仲裁并就债务人财产依法强制执行仍不能履行债务前，保证人对债权人可以拒绝承担保证责任。所以，票据抗辩权不可能有先诉抗辩权。
