释义	如果准许撤回上诉裁定送达之时一审判决送达已满15天，则撤诉裁定送达后，一审判决生效。如果没满，则要等满了15天才能生效。在上诉期内上诉人撤回上诉后，不得再次上诉。但判决是否生效取决于其他上诉人在上诉期内是否上诉。在上诉期内，所有有权提起上诉的上诉人均提起上诉后，均撤回上诉，法院裁定准许最后一个上诉人撤回上诉时，一审裁判生效。
