刑法遗弃伤病军人罪既遂的量刑规定
释义
法律分析：
犯本罪的，处五年以下有期徒刑或者拘役；造成伤病军人重残、死亡或者有其他严重情节的，处五年以上十年以下有期徒刑。重残，一般是指二等以上的残废。其他严重情节是指拒不救治，如遗弃病军人的主观动机恶劣的，拒不救治伤病军人多人或多次的，拒不救治重要伤病军人的，拒不救治伤病军人造成严重后果或恶劣影响的等。
法律依据：
《中华人民共和国刑法》 第四百四十四条 在战场上故意遗弃伤病军人，情节恶劣的，对直接责任人员，处五年以下有期徒刑。
