释义	法律分析：专利诉讼是有关专利纠纷的诉讼。广义上的专利诉讼指所有关于专利权争议的诉讼。狭义的专利诉讼仅指对专利机关有关专利权的决定不服，而向法院提起的诉讼，不包括专利侵权纠纷和专利权的合同纠纷所引起的诉讼。法律依据：《中华人民共和国专利法》第六十六条专利权人或者利害关系人有证据证明他人正在实施或者即将实施侵犯专利权的行为，如不及时制止将会使其合法权益受到难以弥补的损害的，可以在起诉前向人民法院申请采取责令停止有关行为的措施。申请人提出申请时，应当提供担保；不提供担保的，驳回申请。
