释义	民事诉讼当事人包括原告、被告和第三人。以自己的名义提起诉讼，请求法院保护其权益，因而使诉讼成立的人，称为原告。与原告相对的一方，被控侵犯原告权益，需要追究民事责任，并经法院通知其应诉的人，称为被告。对他人之间的诉讼标的有独立的请求权或虽无独立的请求权，但是与案件的处理结果有法律上的利害关系，而参加他人之间正在进行的诉讼的人是第三人。法律依据:《中华人民共和国民事诉讼法》第四十八条:公民、法人和其他组织可以作为民事诉讼的当事人。法人由其法定代表人进行诉讼。其他组织由其主要负责人进行诉讼。
