没交定金合同有效吗

法律分析：有效。如果合同中约定了买家何时支付定金，而买家没有按约定支付的，属于违约行为，可到法院起诉。但合同没有约定何时支付定金，而是订立了类似自支付定金起合同双方开始履行合同约定等条款的，不能起诉。
法律依据：《中华人民共和国民法典》 第五百八十七条 债务人履行债务的，定金应当抵作价款或者收回。给付定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，无权请求返还定金；收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。
