释义	法律分析: 如果是用人单位逾期未签订劳动合同，是用人单位的责任。单位应承担向劳动者每月向劳动者支付双倍工资的责任，但是至多不超过十一个月。如果是劳动者逾期不愿意签合同，则是劳动者的责任，单位可在书面催告后依法与其解约，并且可以不支付经济补偿。法律依据:《《中华人民共和国劳动合同法实施条例》》第六条用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当依照劳动合同法
