释义	法律分析：离职后不需要劳动合同。用人单位不能随意与劳动者解除劳动合同，必须满足一定条件方可进行解除，比如劳动者有重大违反公司规定的行为等，且应该由公司负责进行举证。离职之后劳动者的劳动合同是不需要交还给公司的，需由公司盖好合同废除章之后由个人留存一份。法律依据：《中华人民共和国劳动合同法》第十六条劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
