释义	法律分析：施工合同备案一般情况下是签订合同后到有关部门备案，但也有情况紧急的，后补备案合同的，不过这样的例子很少。法律依据：《中华人民共和国建设工程质量管理条例》第十三条建设单位在开工前，应当按照国家有关规定办理工程质量监督手续，工程质量监督手续可以与施工许可证或者开工报告合并办理。第十四条按照合同约定，由建设单位采购建筑材料、建筑构配件和设备的，建设单位应当保证建筑材料、建筑构配件和设备符合设计文件和合同要求。
