释义	指有配偶又与他人结婚或者明知他人有配偶而与之结婚的行为。具有两种形式：（1）法律上的重婚，即前一婚姻未解除，又与他人办理结婚登记手续而构成的重婚。（2）事实上的重婚：即前一婚姻未解除，又与他人以夫妻名义（或关系）共同生活，虽未办理结婚登记手续，但事实上已构成重婚。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。该内容由陈亚楠律师和点行律询共创回答
