释义	法律分析：发，但雇佣童工是不合法的。如果确实有这种情况也可以通过劳动仲裁，诉讼等法律程序来解决。《中华人民共和国劳动法》第九十四条规定：用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款；情节严重的，由工商行政管理部门吊销营业执照。法律依据：《中华人民共和国劳动合同法》第三十条用人单位应当按照劳动合同约定和国家规定，向劳动者及时足额支付劳动报酬。用人单位拖欠或者未足额支付劳动报酬的，劳动者可以依法向当地人民法院申请支付令，人民法院应当依法发出支付令。
