释义	法律分析：过错方不会净身出户。根据我国相关法律规定，由于夫妻一方存在过错，导致离婚的，无过错方有权请求损害赔偿，但请求损害赔偿不意味着必须要净身出户。净身出户一般由双方约定达成，有过错方认为自己亏钱与无过错方，自愿净身出户。在司法实务中，没有请求损害赔偿就直接判决净身出户的案例。法律依据：《民法典》第一千零九十一条规定：有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：（一）重婚；（二）与他人同居；（三）实施家庭暴力；（四）虐待、遗弃家庭成员；（五）有其他重大过错。
