释义	关于交通事故中的伤残鉴定时机，目前各地法院的做法不一，有的规定是自受到伤害之日起6个月，也有的是3个月，也有的规定1年，有的甚至更长。鉴于人身伤害的起诉时效为1年，并且起算点为：伤害明显的，从受伤害之日起算伤害当时未曾发现，后经检查确诊并能证明是由侵害引起的，从伤势确诊之日起算。这样，就导致一些受害人在受到伤害后如果在1年后经鉴定没有伤残的，可能权利出现“睡眠”之争，与超过诉讼时效的可能。实践操作过程中，应当以治疗终结为准。
